Apple Wins Lawsuit Popular iPod
January 3, 2010 | iPhone, MP3 Player | 1 CommentIn 2006, a class action was filed against Apple, alleging that their popular iPod was defective because it can produce sounds up to 115 decibels, which can cause hearing damage after exposure to long term. The case was dismissed in 2008 because the plaintiffs have not provided proof that iPods are defective, or so they had been personally harmed by their use iPod.

No documents of the trials showed no evidence that the plaintiffs themselves suffered no hearing damage at all. Instead, they said that iPods could theoretically cause hearing damage if used incorrectly.
The Court of Appeals for the Ninth Circuit affirmed that dismissal in 2008. Senior Judge David Thompson said: “At most, the plaintiffs pleaded a potential risk of hearing loss not to themselves but to other unidentified iPod users.” It is for iPod users d ‘properly use their iPod, and that’s how it should be.
